User Code of Conduct Policy
Purpose
The policy provides guidance on standards of expected behaviour for all users of District properties, facilities and services, and outlines consequences when violations of the policy occur.
1. Policy
The District of Oak Bay (the “District”) is committed to promoting a safe, respectful, inclusive and welcoming environment for everyone which:
- Supports the efficient operation of District services;
- Provides equitable access;
- Identifies inappropriate behaviour in District facilities, programs and services; and
- Provides an environment free of discrimination, harassment, danger, physical discomfort, emotional stress, and unfair treatment.
2. Guiding Principles
- A safe, positive and inclusive environment maximizes enjoyment for visitors and staff.
- Participation in recreation benefits individuals and contributes to their quality of life.
- Creating a welcoming, safe and inclusive environment is a collective responsibility of community members and staff.
- Inappropriate behaviour will not be tolerated and should be responded to in an organized and systematic fashion.
- Each visitor to Oak Bay facilities and services is expected to conduct themselves in a manner that respects the rights of others, so that everyone may feel welcome and safe.
3. Scope
This Policy applies to all persons accessing and using municipal recreation centres, arenas, pools, parts, trails, cultural and civic facilities, and related programs and services, whether as a participant, spectator, contractor or visitor. Facility users and participants are responsible to familiarize themselves with this Policy. Groups and organizations using District programs, services, parks and facilities are responsible for the behaviour and actions of all persons associated with their use and are responsible for the enforcement of this Policy.
The Policy applies to inappropriate behaviours which can be intentional or unintentional.
4. Enforcement
- Staff are authorized to enforce the Policy.
- Any User who violates the Policy may be subject to progressive, corrective actions.
- Actions may include but are not limited to:
- Verbal warning and request to stop prohibited behaviour.
- Immediate removal from facility or program.
- Temporary suspension of facility access or program participation.
- Longer-term suspensions.
- Referral to law enforcement authorities depending on the seriousness.
5. Reporting and Investigation
All incidents of inappropriate or prohibited behaviour should be reported to facility staff or management promptly. Reports are recorded and may be investigated to determine appropriate action.
6. Privacy and Records Management
The District will maintain a record of User Code of Conduct related incidents and details of suspensions or appropriate actions. The collection, disclosure and retention of this information follow the expectations of the Freedom of Information and Protection of Privacy Act and other relevant policies.
