Claims with the District

Injury or Property Claims

If you have incurred a loss because of property damage or personal injury and you believe the District of Oak Bay may be responsible, please follow the process outlined below.

Under Section 744 of the Local Government Act, a municipality is not responsible for property damage due to the breakdown or malfunction of a sewer system, water system, or road. For a municipality to be held responsible, it must be found negligent in its maintenance of the system or road in question.

Preparing to submit a claim

Step One

Please contact the Oak Bay department involved to ensure they’re aware of the incident

Step Two

Fill out a Notice of Claim form and submit using the options below

Step Three

For damage or property loss, contact your personal property or home insurer

Submitting your Notice of Claim

Oak Bay requires that claims be submitted in writing using the Notice of Claim form which should be completed and emailed or mailed.

Once your claim has been submitted

  • You will receive a written acknowledgement of your Notice of Claim or letter.
  • An investigation will be commenced. Please note that it may take several weeks for a determination to be made depending on the type of claim, so we suggest that you also contact your insurer to see if coverage exists under your insurance policy.
  • A decision will be made once the investigation is complete.
  • You will be notified in writing of the decision.
